At BLACK ART, we are committed to providing quality products and fair return policies in line with Australian Consumer Law (ACL). This policy outlines the conditions for returns, exchanges, and store credit for both in-store and online purchases.

1. Consumer Rights Under Australian Consumer Law (ACL)

Under ACL, you are entitled to remedies for faulty, defective, or misrepresented products. Businesses cannot refuse a refund, exchange, or repair if the product is faulty, regardless of store policies.

1.1 Major vs. Minor Defects

Major Defect – Refund, Exchange, or Compensation

A product has a major defect if:

  • It is unsafe for use.
  • It has a significant failure that would have prevented purchase if known.
  • It does not match the advertised description or sample.
  • It is unfit for its intended purpose and cannot be fixed within a reasonable time.

For major defects, you are entitled to:

  • A refund, or
  • A replacement, or
  • Compensation for consequential loss.

Minor Defect – Repair or Exchange

A product has a minor defect if it has a fault that can be easily repaired within a reasonable time.

For minor defects, BLACK ART will:

  • Repair the product, or
  • Exchange the item if repair is not possible in a reasonable time.

Refunds are not required for minor defects under ACL.

2. 14-Day Returns & Exchange Policy (Change of Mind or Incorrect Purchase)

We offer exchange or store credit only (no refunds) for change of mind or incorrect purchases within 14 days of purchase, provided that:

  • The item is unused, unworn, and in original condition, with all tags attached.
  • The return is made within 14 days of the original purchase date.
  • A valid proof of purchase (receipt, tax invoice, or bank statement) is provided.

2.1 Store Credit Conditions

  • Store credit will be issued for the full purchase price of the item.
  • Store credit is valid for 3 months from the date of issue.
  • Store credit is non-refundable and cannot be exchanged for cash.

2.2 Exclusions (No Returns or Exchanges for the Following Items)

  • Sale or clearance items (final sale, no exchange).
  • Custom-made, altered, or personalised garments.
  • Underwear, swimwear, socks, and intimate apparel (for hygiene reasons).

3. Returns & Exchange Process

3.1 In-Store Purchases

  • Returns must be made at the same store where the purchase was made.
  • Customers must provide proof of purchase at the time of return.
  • If the return is eligible, customers may choose between exchange or store credit.
  • Refunds will not be issued for change of mind.

3.2 Online Purchases

  • Customers must request an exchange or store credit within 14 days of receiving the item.
  • The customer is responsible for return postage costs, unless the item is faulty.
  • The returned item must be in its original condition, and once approved, store credit or an exchange will be provided.
  • Store credit for online purchases will be issued in the form of a digital voucher.

Processing Time:

  • Once received, returns will be processed within 10 business days.

4. Proof of Purchase Requirement

For all returns, exchanges, and store credit requests, proof of purchase is required. Acceptable forms include:

  • Original printed or digital receipt.
  • Bank statement showing the transaction.

We reserve the right to deny returns without valid proof of purchase.

5. Store Discretion & Abuse of Policy

  • We reserve the right to reject returns that do not meet the conditions stated above.
  • Repeated abuse of the returns policy may result in refusal of future returns or exchanges.

6. Manufacturer Warranties & Faulty Items

For items covered under manufacturer warranties, customers should contact the manufacturer directly, unless the issue falls under ACL.
